In this document we refer to the terms of use when a party (“You,” User,” “Collector,” “Author”) creates, mints, or purchases (“Buy,” “Purchase”) ARTKLs (“Article,” “Text,” “Token,” “Work”) via fx(hash)’s fx(text) (“Platform”).
By engaging with the Platform, and when releasing, minting, buying, selling, collecting, offering on, or trading semi-fungible FA2 ARTKL tokens via the Platform, you understand and acknowledge the terms as presented in this document.
At any point in time, the Platform reserves the right to amend this document. In cases where changes to this document are made to account for edge cases, changes will be effective immediately and, in some instances, retroactively.
General rules
fx(text) aims to foster a safe environment for everybody to publish freely. While doing so, authors will not directly or indirectly expose the Platform or its Users to any harm or liability of any type. This includes, and is not limited to, text which is or contains:
- Unlawful speech, hate speech, homophobia, transphobia, racism, direct and indirect attacks on minorities, xenophobia, ageism, libel, threats, misogyny, or text which otherwise reduces the ability for others to feel safe when using the Platform;
- Content that is not original, infringes on the intellectual property of other parties (including image, audio, design, likeness), or does not contain adequate licensing or citation to identify that it is yours to publish;
- An ARTKL created for ‘slug-sitting’ (i.e., empty articles created with the sole purpose of reserving the slug for whatever reason);
- Content that is designed to intentionally deceive, misinform, or misguide for the financial gain of the Author. This includes changing or otherwise editing the content of an article to convey information, after release, which is not related to that of the original article (except in cases where the changing of Work is part of the artistic merit of the Work);
- Solicit personal information unless explicit permission is granted and in line with local laws;
- Incentivising the purchase of ARTKLs by offering financial rewards.
Failure to comply with these rules means the Platform may moderate the Token without notice.
Your rights as an author
An Author refers to the party creating and minting the ARTKL on fx(text). As an Author, you reserve the right to change, amend and update your article to fix, add, remove, or redact information within your article as long as the changes aren’t deceptive and are made in good faith. Exceptions to this rule include those which are part of a performance. Some examples of cases where edits are permissible include and aren’t limited to;
- Updating data, stats, or numbers to accurately reflect the most recent information;
- Updating images, video, audio, or design elements to accurately reflect the most recent information;
- Updating or adding attribution to accurately reflect the rights of the assets used;
- Correcting text to correct spelling and grammar mistakes;
- Appending text to add clarity to existing elements.
Your rights as a collector
A collector refers to anyone in possession of an ARTKL via the Platform. As a collector, you automatically reserve the right to collect, display, reproduce, sell, and trade ARTKLs in your possession. However, unless explicitly expressed by the Author, the collector does not have the right to;
- To permit a third party to reproduce, sell, or modify the Work;
- To reproduce the Work as your own, in whole or part, especially without attribution;
- To include the Work within private shows, exhibitions, or publications;
- To modify or edit the Work, making it unrepresentative of the Work’s Author.
Our rights as a Platform
The Platform reserves some rights to use Work produced on the Platform, in whole or in part, within marketing media (e.g. social media, print, exhibition, interview, audio, video, design, blogs), digital environments (e.g. the Platform, online galleries), and operations (e.g. the Platform). The Platform may also host, store, and distribute the Work via distributed file systems such as IPFS.
Please note that in almost all cases, the Platform will contact the Author to ask permission prior to any usage of the Work.
